Digital Millennium Copyright Act (DMCA) Policy
SoBrief respects the intellectual property rights of others and expects users of our website and services to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to claims of copyright infringement committed using our website if such claims are reported to our Designated Copyright Agent as described below.
Notification of Infringement
If you believe that any content on SoBrief has been used in a way that constitutes copyright infringement, please send a written DMCA notice that includes the following:
- Your name, address, phone number, and email address.
- A description of the copyrighted work that you claim has been infringed.
- The URL(s) or location(s) on our website where the allegedly infringing material appears.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
- Your physical or electronic signature.
Counter-Notification
If you believe that material you posted on SoBrief was removed or access to it was disabled by mistake or misidentification, you may submit a counter-notification to our DMCA agent with the following information:
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which SoBrief may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Repeat Infringers
In accordance with the DMCA and other applicable law, SoBrief has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. SoBrief may also, at its sole discretion, limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
